TERMS OF ENROLLMENT
Power Voice for Singers — Online Course
Effective Date: May 3, 2026
These Terms of Enrollment (“Agreement”) govern your access to and use of the Power Voice for Singers online course (“Course”) offered by Uniqera LLC, a California limited liability company doing business as Asli Ozer Gilbert (“Company”), through asligilbert.com. By purchasing or accessing the Course, you (“Student”) agree to be bound by the terms set forth below.
1. Course Description
Power Voice for Singers is a self-paced video course designed to help singers develop vocal strength, technique, and confidence. The Course consists of pre-recorded video lessons and any accompanying materials made available through the Company’s online course platform on asligilbert.com.
This Course does not include live instruction, one-on-one coaching, or real-time feedback. Any such services are offered separately under a distinct Service Agreement.
2. Enrollment and Access
Upon completing payment, Student will receive access to the Course through the platform hosted on asligilbert.com. Access is granted to the individual Student only and is non-transferable.
Lifetime Access. Student is granted lifetime access to the Course content as it exists at the time of enrollment and any future updates Company chooses to add at its sole discretion. “Lifetime” refers to the life of the Course on Company’s platform. In the unlikely event that Company discontinues the Course or its hosting platform, Company will provide reasonable advance notice and, where practicable, offer Student an opportunity to download available materials.
Access is subject to Student’s continued compliance with this Agreement. Company reserves the right to revoke access for violation of any term herein.
3. Fees and Payment
The Course requires payment in full at the time of enrollment. All fees are listed in U.S. dollars and processed through the payment platform available on asligilbert.com. By submitting payment, Student authorizes the charge in the amount displayed at checkout.
Company does not offer installment plans or deferred billing unless expressly stated in writing at the time of purchase.
4. Refund Policy — 30-Day Satisfaction Guarantee
Company offers a 30-day money-back guarantee for the Course, subject to the following conditions. Refund requests that do not meet all conditions below will not be honored.
To qualify for a refund, Student must:
- Submit a written refund request to Company via the contact page at asligilbert.com within thirty (30) calendar days of the original purchase date;
- Have completed a minimum of the first two (2) modules of the Course — Module 1: How Our Voice Works and Module 2: Voice-Body Connection — demonstrating a genuine attempt to engage with the material; and
- Not have completed the Course in its entirety. Students who have accessed and viewed all Course modules have consumed the full value of the Course and are not eligible for a refund.
Additional conditions:
- Only one (1) refund is permitted per Student, per lifetime. Students who have previously received a refund on this or any other Company course are not eligible;
- Upon approval of a refund, Student’s access to the Course will be immediately and permanently revoked;
- Refunds will be issued to the original payment method within 5–10 business days, depending on the payment processor;
- Company reserves the right to request verification of course completion data prior to approving any refund request.
Requests submitted after the 30-day window, or that do not meet the above conditions, will not be considered. Student is encouraged to review all available course information and preview content prior to purchase to ensure the Course is a suitable fit.
5. Permitted Use
Company grants Student a limited, non-exclusive, non-transferable, personal license to access and view the Course content for personal, non-commercial use only. Student may not:
- Share login credentials or grant access to any third party;
- Download, copy, reproduce, screen-record, or capture any Course content without express written permission from Company;
- Redistribute, resell, sublicense, or otherwise make Course content available to others in any format;
- Use Course content to create derivative works or competing products;
- Use Course content for any commercial purpose without prior written consent from Company.
Violation of these restrictions may result in immediate termination of access and may expose Student to legal liability.
6. Intellectual Property
All Course content — including but not limited to video lessons, audio recordings, written materials, exercises, frameworks, and branding — is the exclusive intellectual property of Uniqera LLC and is protected by U.S. and international copyright law. Nothing in this Agreement transfers any ownership rights to Student.
Unauthorized reproduction or distribution of Course content constitutes copyright infringement and will be pursued to the fullest extent permitted by law.
7. Health, Medical Disclaimer, and Assumption of Risk
The Course is intended for educational purposes only. Content related to vocal technique, warm-ups, and exercises does not constitute medical advice, diagnosis, or treatment. Nothing in the Course creates a professional or clinical relationship between Company and Student.
Vocal exercises carry inherent physical risks, including but not limited to vocal strain, hoarseness, vocal cord damage, loss of voice, or other injury to the throat, larynx, or surrounding structures. These risks exist regardless of how carefully instructions are followed, and may be increased by factors entirely outside Company’s knowledge or control, including but not limited to Student’s pre-existing health conditions, physical limitations, vocal health at the time of practice, hydration, fatigue, environment, and failure to warm up or cool down properly.
Because this is a self-paced online course, Company has no ability to observe, supervise, correct, or monitor Student’s technique, physical condition, or practice habits in real time. Student is solely responsible for how they engage with Course exercises and materials.
By enrolling in the Course, Student expressly acknowledges and agrees to the following:
- Student assumes full and sole responsibility for any and all risk of injury, vocal damage, or harm arising from participation in the Course, including exercises performed incorrectly, excessively, or without appropriate rest;
- Student will stop immediately and seek the advice of a licensed medical professional if they experience any pain, discomfort, hoarseness, loss of voice, or unusual physical symptoms before, during, or after any vocal exercise;
- Student will not participate in Course exercises if they have a known vocal injury, active illness, or condition affecting the throat or voice without first obtaining medical clearance;
- Company is not responsible for any physical harm, vocal damage, medical expenses, loss of income, or any other damages of any kind resulting from Student’s use of or participation in Course content, regardless of whether such harm was foreseeable.
To the maximum extent permitted by applicable law, Company, its members, officers, employees, and agents are fully released from any and all liability related to physical or vocal injury sustained by Student in connection with this Course. This release applies whether the injury results from Student’s own actions, failure to follow instructions, pre-existing conditions, or any other cause.
8. No Guarantee of Results
Company has designed this Course with care and expertise. However, results are not guaranteed. Vocal improvement depends on individual factors including consistent practice, physical health, prior experience, and personal effort — all of which are outside Company’s control. Student acknowledges that outcomes will vary.
Any testimonials or examples of results shared in connection with this Course represent individual experiences and are not a guarantee of similar outcomes.
9. Course Updates and Changes
Company may update, modify, add to, or remove Course content at its sole discretion to improve quality, accuracy, or relevance. Company is under no obligation to notify Student of routine updates. Significant changes that materially reduce the Course’s scope will be communicated to enrolled Students where reasonably practicable.
10. Privacy
Company’s collection, use, and storage of Student personal data is governed by the Privacy Policy available at asligilbert.com. By agreeing to these terms, Student consents to the data practices described therein. Company complies with applicable data privacy laws, including the California Consumer Privacy Act (CCPA).
11. Limitation of Liability
To the maximum extent permitted by applicable law, Company’s total liability to Student for any claim arising out of or related to this Agreement or the Course shall not exceed the amount paid by Student for the Course.
In no event shall Company be liable for any indirect, incidental, consequential, punitive, or special damages, including but not limited to loss of income, loss of opportunity, or emotional distress, even if Company has been advised of the possibility of such damages.
12. Indemnification
Student agrees to indemnify, defend, and hold harmless Uniqera LLC, its members, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) Student’s use of the Course; (b) Student’s breach of this Agreement; or (c) Student’s violation of any applicable law or third-party rights.
13. Dispute Resolution
The parties agree to attempt to resolve any dispute arising out of this Agreement through good-faith negotiation before initiating formal proceedings.
If the dispute cannot be resolved informally within thirty (30) days, it shall be submitted to binding arbitration in Los Angeles County, California, administered under the rules of the American Arbitration Association (AAA). The arbitrator’s decision shall be final and binding. Each party shall bear its own attorneys’ fees unless the arbitrator determines otherwise.
Notwithstanding the above, either party may seek injunctive or equitable relief in a court of competent jurisdiction to prevent irreparable harm, including to protect intellectual property rights.
14. Governing Law and Venue
This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal proceedings not subject to arbitration shall be brought exclusively in the state or federal courts located in Los Angeles County, California.
15. Modifications to This Agreement
Company reserves the right to update these Terms of Enrollment at any time. Updated terms will be posted on asligilbert.com and will be effective upon posting. For Students already enrolled at the time of a modification, the terms in effect at the time of purchase shall continue to govern their enrollment unless Student expressly agrees to updated terms.
16. Entire Agreement and Severability
This Agreement constitutes the entire agreement between the parties regarding Student’s enrollment in and access to the Course, and supersedes all prior or contemporaneous discussions or agreements, whether oral or written.
If any provision of this Agreement is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
17. Waiver
Company’s failure to enforce any provision of this Agreement on any occasion shall not constitute a waiver of its right to enforce that provision in the future.
18. Contact
For questions regarding this Agreement or the Course, please contact Company through the contact page at asligilbert.com.
